I am very surprised that a game licensed from a major movie franchise, after so many years in development (hell), could somehow end up being bad.

Destructoid supposedly talked to a dev that worked on Colonial Marines briefly between 2007 and 2008. He again corroborates that Gearbox put A: CM on the sidelines for Borderlands. It says they took resources and people off of the former to work on the latter, then when Sega pulled the plug in 2008 they outright lied to both Sega and 2K about how many people were working on each project. This led to a round of lay-offs in 2008 (and the dev notes that the developer was losing members along the way).
The dev goes on to say he spoke to people still on the project in 2012 and they said they didn't honestly expect it to ship in February because of how sad of a state the game was in. It sounds like employees/devs at that time honestly expected it to be delayed again.

I really hope SEGA sues Gearbox and wins. SEGA has been trying really hard to improve its image as of late and this game is a massive embarrassment to both the publisher and the developer. Fuck Gearbox Software.

Ultimately, it all depends on the contractual agreement. Gearbox was contracted to develop the game to completion, regardless of final quality. Sega can't have case if Gearbox did everything per the contract. However, if it IS discovered beyond a reasonable doubt that Gearbox used money from Sega ($60 million invested into the game from Sega) intended for A:CM was invested into Borderlands 2 or other Gearbox projects (and that accusation is pretty serious already that they lied to Sega and 2K about the staff numbers), Sega will have very good footing to beat Gearbox a new one.
